INVITATION TO APPLY FOR ELIGIBILITY AND TO BID

The Philippine Economic Zone Authority (PEZA), through its Corporate Operating Budget for the CY 2008 intends to apply the sum of PhP 13,569,421.79 being the Approved Budget for Contract (ABC) to payments under the contract for the Asphalt Overlay Phase III Project at the Mactan Economic Zone. Bids received in excess of the ABC shall be automatically rejected at Bid opening.

The PEZA now calls for the submission of Letters of Intent (LOIs), certified copy of Phil-GEPS Certificate of Registration, and proof of enrolment with the e-FPS from potential bidders to apply for eligibility and to bid for the Asphalt Overlay Phase III Project at the Mactan Economic Zone.

Bidders should possess a valid PCAB license applicable to the above type and cost of the contract, have completed a single similar contract with a value of at least fifty percent (50%) of the ABC within the last three (3) years and met the other minimum eligibility requirements stated in the Eligibility Documents. In addition, bidders must have filed their latest annual income and business tax returns (VAT and / or Percentage Taxes covering six [6] months immediately prior to the submission of bids) via the Electronic Filing and Payment System (eFPS) of the Bureau of Internal Revenue.

Interested Bidders must submit their LOIs, certified copy of Phil-GEPS Certificate of registration, and proof of enrolment with the e-FPS not later than 20 May 2008 at the address given below and secure the Eligibility Documents therefrom upon payment of a non-refundable fee of Php1,000.00. Applications for eligibility will be evaluated on a pass/fail basis. The last day for the submission of the accomplished Eligibility Documents shall be on 26 May 2008, 2:00 PM at the address given below. Only those Bidders passing the eligibility check will be entitled to purchase the Bidding Documents.

Bidding will be conducted through open competitive bidding procedures using non-discretionary pass / fail criteria as specified in the Implementing Rules and Regulations Part A (IRR-A) of Republic Act 9184 (R.A. 9184), otherwise known as the “Government Procurement Reform Act,” and is restricted to Filipino citizens / sole proprietorships, organizations with at least seventy-five percent (75%) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws and regulations of which grant similar rights or privileges to Filipino citizens, pursuant to Republic Act 5183 (R.A. 5183) and subject to Commonwealth Act 138 (C.A. 138). Only Bids of Bidders who pass the eligibility check will be opened. The process for the eligibility check is described in Section II, ITB. The Bidder with the Lowest Calculated Bid (LCB) shall advance to the post-qualification stage in order to finally determine responsiveness of the bid to technical and financial requirement of the project. The contract shall then be awarded to the Lowest Calculated and Responsiveness bidder (LCRB) who was determined as such during the post-qualification procedure.

Interested Bidders shall submit their accomplished Eligibility Documents to the BAC Secretariat at the 2/F PEZA Administration Bldg., Mactan Economic Zone, Lapulapu City on or before 2:00 PM of 26 May 2008.

Interested eligible bidders may obtain further information from the PEZA and inspect the Bidding Documents at the address given below from 7:30 AM to 4:30 PM on 30 May -04 June 2008.

A complete set of Bidding Documents may be purchased by Bidders that passed the eligibility check upon the presentation of the Notice of Eligibility to the BAC Secretariat, at the address below and upon payment of a non-refundable fee of Php10,000.00. The Bidding Documents shall be received personally by the bidder or his authorized representative on or before 04 June 2008.

The PEZA will hold a Pre-Bid Conference open to all eligible bidders on 06 June 2008, 2:00 PM.

Eligible Bidders must submit their Bids at the address below on or before 2:00 PM of 20 June 2008. All bids must be accompanied by a Bid Security in the form of GSIS Surety Bond in the amount not less than 2.5% of the ABC or in the form of cash, certified check, cashier’s check, bank draft or irrevocable letter of credit in the amount not less than 1% of the ABC, Late bids will not be accepted. Bid opening shall be on 20 June 2008, 2:00 PM at the address given below. Bids will be opened in the presence of the Bidders’ representatives who choose to attend.

In accordance with the IRR-A of R.A 9184, only Bids from eligible Bidders will be opened. In accordance with the IRR-A of R.A. 9184 a contract will only be awarded to the Lowest Calculated and Responsive Bidder who was determined as such during post-qualification.

In case any of the above date/s is declared as a non-working holiday it will automatically be rescheduled on the next working day (same time).

Completion of Works is required within 30 calendar days from date of receipt of the Notice to Proceed.

The PEZA reserves the right to accept or reject any Bid, to annul the bidding process, and to reject all Bids at any time prior to contract award, without thereby incurring any liability to the affected Bidder or Bidders.
